Privacy Policy

Introduction and Acceptance

The websites located at nailaddictsonline.com and courses.nailaddicts.com, together with all associated subdomains, landing pages, checkout pages, online courses, membership areas, and forms (collectively, the "Website"), are owned and operated by Malvagio LLC, a Michigan limited liability company doing business as Nail Addicts ("Nail Addicts," the "Company," "we," "us," or "our").

This Privacy Policy describes how we collect, use, store, share, and protect personal information in connection with all of our business operations, including, without limitation: our nail salon services; our nail artist education programs, including in-person classes, workshops, events, online courses, memberships, coaching, and consulting; the sale of digital and physical products; and any related marketing, advertising, and communications (collectively, the "Services"). This Privacy Policy applies to information collected through the Website, through our social media accounts and advertisements (including lead generation forms on platforms such as Facebook and Instagram), by email, text message, telephone, or direct message, and in person at our salon, classes, and events.

For purposes of this Privacy Policy, "personal information" or "personal data" means any information that identifies, relates to, or could reasonably be linked, directly or indirectly, with a particular individual.

By accessing or using the Website or Services, submitting any form, making a purchase, registering for or attending a class or event, or otherwise providing information to us, you acknowledge that you have read and understood this Privacy Policy and agree to be bound by its terms. You further represent that you are at least eighteen (18) years of age and have the legal capacity to enter into this agreement. If you do not agree with this Privacy Policy, you must not access or use the Website or Services, and you should contact us at support@nailaddicts.com with any questions.

Updates to This Privacy Policy

We reserve the right to modify or update this Privacy Policy at any time. Any changes will be effective immediately upon posting the revised Privacy Policy on the Website, and the "Last Updated" date below will be revised accordingly. In the event of a material change to how we collect, use, or share personal information, we will provide notice by email to the address associated with your account or by a prominent notice on the Website. Your continued use of the Website or Services after any change constitutes your acceptance of the updated Privacy Policy. We encourage you to review this Privacy Policy periodically.

Personal Information We Collect

Information You Voluntarily Provide. We collect personal information that you choose to provide to us, including when you request a free resource, subscribe to our email list, complete a form or questionnaire, register for a class or event, purchase a product or program, book a service, apply for a position, or otherwise contact us. This information may include your name, email address, telephone number, mailing and billing address, date of birth, business name and contact details, professional background and experience level, the name you wish to appear on a certificate, your responses to registration or intake questions, and the content of any message or correspondence you send to us. Your decision to provide this information is voluntary and constitutes your consent to our collection, processing, and retention of it in accordance with this Privacy Policy and any communication preferences you select.

Communications. When you contact us by email, telephone, text message, our Website, or through a social media platform, we may collect your name, contact information, any information made available to us by that platform, and the content of your communication. We process this information based on our legitimate interest in responding to your inquiries and may retain records of these communications.

Customers and Purchases. If you purchase a product, program, or service, we collect the additional information necessary to complete and fulfill your order, such as your billing address and transaction details. All payments are processed by secure third-party payment processors (which may include Stripe, PayPal, Klarna, Afterpay, and processors integrated with our course and checkout platform). Your full payment card and financial account information is collected and stored by those processors, not by us, and we do not have access to it.

In-Person Classes, Events, and Salon Services. If you register for or attend an in-person class or event, or receive services at our salon, we may collect information such as your attendance, progress, and appointment history, and any dietary restrictions, food allergies, or other information you choose to share so that we may provide a safe experience. Such information is used solely for the purpose for which it was provided and is never used for marketing. Salon appointments may be scheduled through a third-party booking platform, which collects and processes information under its own privacy policy.

User Content. We may collect and process comments, reviews, testimonials, photographs, videos, and other content that you post on our Website, social media pages, or online communities, or that you otherwise submit to us.

Information Collected Automatically. When you access the Website or interact with our emails and advertisements, we and our service providers may automatically collect information about your device and usage, including your IP address, browser type, operating system, referring website, pages viewed, links clicked, time spent on pages, and general location derived from your IP address. We collect this information using cookies, web beacons, pixels (including the Meta Pixel), analytics tools (including Google Analytics), and similar technologies. Cookies may be session cookies, which expire when you close your browser, or persistent cookies, which remain on your device until deleted. You may configure your browser to refuse or delete cookies or to alert you when cookies are being used; however, certain features of the Website may not function properly without them. The Website does not currently respond to "Do Not Track" signals.

Information from Third Parties. We may receive personal information about you from third parties, including social media and advertising platforms (for example, when you submit a lead form through an advertisement on Facebook or Instagram), analytics providers, search engines, our course and checkout platform, and payment processors.

Sensitive Information. We do not intentionally collect sensitive personal information, such as information relating to your racial or ethnic origin, religious or political beliefs, sexual orientation, genetic or biometric data, or criminal history. Other than dietary or allergy information you voluntarily provide for in-person events, we ask that you not send us any sensitive personal information.

Lawful Grounds for Processing

To the extent the European Union General Data Protection Regulation ("GDPR") or the United Kingdom GDPR applies, we process personal information only where we have a lawful basis to do so, including: (a) your consent, such as when you opt in to receive a free resource or marketing communications; (b) the performance of a contract, such as when you purchase a product or register for a class; (c) our legitimate interests, such as responding to inquiries, improving our Services, and marketing to individuals who have expressed interest in our offerings, provided those interests are not overridden by your rights; and (d) compliance with our legal obligations. Where we rely on consent, you may withdraw it at any time by contacting us, without affecting the lawfulness of processing carried out before withdrawal. Where required by the UK Privacy and Electronic Communications Regulations, we will send electronic marketing only to individuals who have purchased or inquired about our Services and did not opt out, or who have otherwise consented.

How We Use Your Information

You have the right to understand how your information is used. We use the personal information we collect for the following purposes:

  • To provide, operate, and deliver the Services, resources, classes, courses, coaching, and products you request or purchase
  • To process transactions and send related confirmations, receipts, and notices
  • To communicate with you, respond to inquiries, and follow up regarding a class, program, product, or service in which you have expressed interest
  • To prepare for and conduct in-person classes and events, including certificates, materials, and catering
  • To provide customer support before, during, and after your purchase or attendance
  • To send newsletters, educational content, promotional offers, and information about products, services, and events that may interest you
  • To notify you of changes to our Services or policies
  • To personalize content and advertising and to measure the effectiveness of our marketing
  • To analyze usage trends and improve the Website, Services, and user experience
  • To detect, prevent, and address fraud, security issues, and technical problems
  • To comply with legal obligations, resolve disputes, and enforce our agreements and policies

Email Communications. If you subscribe to our list, opt in to a free resource, or make a purchase, we may send you educational, informational, and promotional emails. In compliance with the CAN-SPAM Act, every marketing email we send will identify us as the sender, include our physical mailing address, and provide a clear method to unsubscribe. You may opt out at any time by clicking the unsubscribe link in any email. Even after opting out of marketing emails, you may continue to receive transactional messages related to purchases or registrations.

SMS, Text Message, and Telephone Communications. If you provide your telephone number to us, we may contact you by telephone call or text message regarding your inquiry, registration, purchase, appointment, or class. If you provide your express written consent to receive marketing communications by text message or telephone (for example, by checking a consent box, submitting a form that discloses such consent, or texting a keyword to us), you agree that we may send recurring marketing and promotional calls and text messages to the number provided, which may be sent using an automated telephone dialing system, artificial or prerecorded voice, or similar technology. Consent to receive marketing messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and you may reply HELP for assistance. You may opt out of telephone communications by requesting removal during any call or by contacting us at support@nailaddicts.com. We comply with the Telephone Consumer Protection Act (TCPA) and all other applicable laws and will honor opt-out requests promptly. We will not sell, rent, or share your mobile telephone number or text messaging consent with any third party for that party's own marketing purposes.

Photographs and Video. We may photograph or record video at our salon, classes, and events. We will feature identifiable individuals in our marketing materials, Website, or social media only with their consent. If you have consented and later wish to revoke that consent, please contact us, and we will remove the content from our owned channels and cease future use where reasonably practicable. Content previously published or shared by third parties may not be retrievable.

Advertising and Custom Audiences. We advertise on third-party platforms, including Facebook and Instagram. Where permitted by law and based on your consent or our legitimate interest in marketing, we may share hashed (encrypted) contact information, such as your email address or telephone number, with these platforms to deliver relevant advertisements, to exclude you from certain advertisements, or to create "lookalike" audiences of individuals with similar characteristics. You may manage your advertising preferences directly within your account settings on those platforms.

Artificial Intelligence and Automated Tools. We may use automated systems and artificial intelligence tools to assist with data analysis, content creation, customer service, and improving our marketing. These tools may process information such as usage patterns and interactions with our Website and communications. We do not use automated decision-making that produces legal or similarly significant effects on you.

Non-Personally Identifiable Information. We may use aggregated or de-identified information that cannot reasonably be used to identify you for any lawful purpose, including to understand how visitors use the Website, diagnose technical problems, and determine which content is most useful.

How Information Is Stored and Shared

We do not sell, rent, or trade your personal information. We share personal information only as described below and only to the extent reasonably necessary:

  • Service Providers. We share information with third-party vendors that perform services on our behalf, such as website and course hosting, payment processing, email and SMS delivery, customer relationship management, scheduling, analytics, and advertising. These providers may access personal information only as needed to perform their functions and are required to protect it in accordance with applicable law.
  • Our Team and Professional Advisors. Members of our team, independent contractors who assist in delivering our Services, and our legal, accounting, and financial advisors may access personal information as necessary, subject to obligations of confidentiality.
  • Partners and Affiliated Offers. We do not share your personal information with the product brands, manufacturers, certification organizations, or educational partners with whom we collaborate, unless you provide your express consent at the time of collection. If we ever offer a resource or program jointly with another company, we will clearly disclose any sharing on the relevant page and share only the information necessary.
  • Legal Requirements and Protection of Rights. We may disclose personal information if required to do so by law, subpoena, court order, or governmental request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of the Company, our clients, or others; to investigate or prevent fraud or a suspected violation of law; or to enforce our policies and agreements.
  • Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or similar transaction involving all or part of our business, personal information may be transferred to the successor entity, which will remain bound by the terms of this Privacy Policy with respect to information previously collected.
  • With Your Consent. We may share personal information for any other purpose with your consent.

Data Controller and Processors. For purposes of applicable data protection laws, Malvagio LLC acts as the data controller of your personal information, meaning we determine the purposes and means of its processing. We engage third-party data processors to store and process information on our behalf, and we take reasonable steps to select processors that maintain appropriate privacy and security practices.

International Data Transfers. Our business and our service providers are located in and operate within the United States. If you access the Website or provide information to us from outside the United States, your information will be transferred to, stored, and processed in the United States, which may have data protection laws different from those of your country of residence. By providing your information, you consent to this transfer. Regardless of location, your information will be handled in accordance with this Privacy Policy.

Information Protection and Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure, including the use of Secure Sockets Layer (SSL) encryption on the Website and reputable third-party providers that maintain industry-standard security measures. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

In the event we become aware of a security breach involving your personal information, we will notify affected individuals and appropriate authorities as required by applicable law, including the Michigan Identity Theft Protection Act.

To the fullest extent permitted by law, the Company shall not be liable for any unauthorized access to, or use or disclosure of, personal information resulting from the acts or omissions of third parties beyond our reasonable control, including hacking, interception, or other criminal activity, and you agree to release and hold the Company harmless from any claims arising from such unauthorized third-party conduct.

Based on the nature and scale of our processing activities, we have determined that we are not required to appoint a Data Protection Officer. Privacy inquiries may be directed to us using the contact information below.

Data Retention

We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, including for as long as you remain subscribed to our communications or remain a client, to fulfill purchases and provide ongoing support, and to comply with our legal, tax, accounting, and reporting obligations, resolve disputes, and enforce our agreements. When personal information is no longer needed, we will securely delete or anonymize it. If you request deletion, we will delete your information except where retention is required or permitted by law.

Your Rights to Control Your Information

You have the right to access, update, correct, or delete the personal information we hold about you. You may unsubscribe from our email list at any time by clicking the "unsubscribe" link at the bottom of any marketing email, and you may opt out of text messages at any time by replying STOP. To exercise any of the rights described in this section, contact us at no charge using the information in the Contact Us section below. Right to Rectification. You may request that we correct or update any personal information that is inaccurate or incomplete.

Right to Erasure. You may request that we delete your personal information, subject to any retention obligations required by law. You may also withdraw your consent to marketing communications at any time, after which we will remove you from our marketing lists.

Right to Restriction of Processing. You may request that we limit the processing of your personal information in certain circumstances, such as while you contest its accuracy.

Right to Data Portability. You may request that we provide your personal information in a structured, commonly used, and machine-readable format, or transfer it to another controller where technically feasible.

Right to Object. You may object to our processing of your personal information where we rely on our legitimate interests, including for direct marketing purposes.

Right to Withdraw Consent. Where processing is based on your consent, you may withdraw that consent at any time.

State Privacy Rights

California Residents. If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), may provide you with additional rights, including the right to know the categories and specific pieces of personal information we collect, the sources of that information, the purposes for which we use it, and the categories of third parties with whom we share it, all of which are described in this Privacy Policy. You may also have the right to request deletion or correction of your personal information, to opt out of the sale or sharing of personal information for cross-context behavioral advertising, and to limit the use of sensitive personal information. We do not sell personal information. We will not discriminate against you for exercising any of these rights.

We do not knowingly collect, solicit, or market to anyone under the age of 18, and we do not knowingly collect personal information from children under the age of 13 in compliance with the Children's Online Privacy Protection Act (COPPA). If we learn that we have collected personal information from a person under 18, we will promptly delete it. This Privacy Policy and any dispute arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of Michigan and applicable federal law of the United States, without regard to conflict of law principles. To the extent the GDPR or other foreign data protection law applies to your personal information, we will honor the rights it provides. You agree that any legal action arising out of or relating to this Privacy Policy shall be brought exclusively in the state or federal courts located in Macomb County, Michigan, and you consent to the personal jurisdiction of those courts.
